  29. Considerations for the public: By using one of our public licenses,
  30. a licensor grants the public permission to use the licensed material

  34. by the license. Our licenses grant only permissions under copyright and

  42. Creative Commons Attribution 4.0 International Public License
  43. By exercising the Licensed Rights (defined below), You accept and agree to
  44. be bound by the terms and conditions of this Creative Commons Attribution
  45. 4.0 International Public License ("Public License"). To the extent this
  46. Public License may be interpreted as a contract, You are granted the
  47. Licensed Rights in consideration of Your acceptance of these terms and
  48. conditions, and the Licensor grants You such rights in consideration
  49. of benefits the Licensor receives from making the Licensed Material
  50. available under these terms and conditions.
  51. Section 1 – Definitions.
  52. a. Adapted Material means material subject to Copyright and Similar Rights
  53. that is derived from or based upon the Licensed Material and in which
  54. the Licensed Material is translated, altered, arranged, transformed, or
  55. otherwise modified in a manner requiring permission under the Copyright
  56. and Similar Rights held by the Licensor. For purposes of this Public
  57. License, where the Licensed Material is a musical work, performance, or
  58. sound recording, Adapted Material is always produced where the Licensed
  59. Material is synched in timed relation with a moving image.
  60. b. Adapter's License means the license You apply to Your Copyright and
  61. Similar Rights in Your contributions to Adapted Material in accordance
  62. with the terms and conditions of this Public License.
  63. c. Copyright and Similar Rights means copyright and/or similar rights
  64. closely related to copyright including, without limitation, performance,
  65. broadcast, sound recording, and Sui Generis Database Rights, without
  66. regard to how the rights are labeled or categorized. For purposes of
  67. this Public License, the rights specified in Section 2(b)(1)-(2) are
  68. not Copyright and Similar Rights.
  69. d. Effective Technological Measures means those measures that, in
  70. the absence of proper authority, may not be circumvented under laws
  71. fulfilling obligations under Article 11 of the WIPO Copyright Treaty
  72. adopted on December 20, 1996, and/or similar international agreements.
  73. e. Exceptions and Limitations means fair use, fair dealing, and/or
  74. any other exception or limitation to Copyright and Similar Rights that
  75. applies to Your use of the Licensed Material.
  76. f. Licensed Material means the artistic or literary work, database,
  77. or other material to which the Licensor applied this Public License.
  78. g. Licensed Rights means the rights granted to You subject to the terms
  79. and conditions of this Public License, which are limited to all Copyright
  80. and Similar Rights that apply to Your use of the Licensed Material and
  81. that the Licensor has authority to license.
  82. h. Licensor means the individual(s) or entity(ies) granting rights under
  83. this Public License.
  84. i. Share means to provide material to the public by any means or process
  85. that requires permission under the Licensed Rights, such as reproduction,
  86. public display, public performance, distribution, dissemination,
  87. communication, or importation, and to make material available to the
  88. public including in ways that members of the public may access the
  89. material from a place and at a time individually chosen by them.
  90. j. Sui Generis Database Rights means rights other than copyright resulting
  91. from Directive 96/9/EC of the European Parliament and of the Council of
  92. 11 March 1996 on the legal protection of databases, as amended and/or
  93. succeeded, as well as other essentially equivalent rights anywhere in
  94. the world.
  95. k. You means the individual or entity exercising the Licensed Rights
  96. under this Public License. Your has a corresponding meaning.
  97. Section 2 – Scope.
  98. a. License grant.
  99. 1. Subject to the terms and conditions of this Public License, the
  100. Licensor hereby grants You a worldwide, royalty-free, non-sublicensable,
  101. non-exclusive, irrevocable license to exercise the Licensed Rights in
  102. the Licensed Material to:
  103. A. reproduce and Share the Licensed Material, in whole or in part; and
  104. B. produce, reproduce, and Share Adapted Material.
  105. 2. Exceptions and Limitations. For the avoidance of doubt, where
  106. Exceptions and Limitations apply to Your use, this Public License does
  107. not apply, and You do not need to comply with its terms and conditions.
  108. 3. Term. The term of this Public License is specified in Section 6(a).
  109. 4. Media and formats; technical modifications allowed. The Licensor
  110. authorizes You to exercise the Licensed Rights in all media and
  111. formats whether now known or hereafter created, and to make technical
  112. modifications necessary to do so. The Licensor waives and/or agrees not
  113. to assert any right or authority to forbid You from making technical
  114. modifications necessary to exercise the Licensed Rights, including
  115. technical modifications necessary to circumvent Effective Technological
  116. Measures. For purposes of this Public License, simply making modifications
  117. authorized by this Section 2(a)(4) never produces Adapted Material.
  118. 5. Downstream recipients.
  119. A. Offer from the Licensor – Licensed Material. Every recipient of
  120. the Licensed Material automatically receives an offer from the Licensor
  121. to exercise the Licensed Rights under the terms and conditions of this
  122. Public License.
  123. B. No downstream restrictions. You may not offer or impose any additional
  124. or different terms or conditions on, or apply any Effective Technological
  125. Measures to, the Licensed Material if doing so restricts exercise of
  126. the Licensed Rights by any recipient of the Licensed Material.
  127. 6. No endorsement. Nothing in this Public License constitutes or may be
  128. construed as permission to assert or imply that You are, or that Your
  129. use of the Licensed Material is, connected with, or sponsored, endorsed,
  130. or granted official status by, the Licensor or others designated to
  131. receive attribution as provided in Section 3(a)(1)(A)(i).
  132. b. Other rights.
  133. 1. Moral rights, such as the right of integrity, are not licensed under
  134. this Public License, nor are publicity, privacy, and/or other similar
  135. personality rights; however, to the extent possible, the Licensor waives
  136. and/or agrees not to assert any such rights held by the Licensor to the
  137. limited extent necessary to allow You to exercise the Licensed Rights,
  138. but not otherwise.
  139. 2. Patent and trademark rights are not licensed under this Public License.
  140. 3. To the extent possible, the Licensor waives any right to collect
  141. royalties from You for the exercise of the Licensed Rights, whether
  142. directly or through a collecting society under any voluntary or waivable
  143. statutory or compulsory licensing scheme. In all other cases the Licensor
  144. expressly reserves any right to collect such royalties.
  145. Section 3 – License Conditions.
  146. Your exercise of the Licensed Rights is expressly made subject to the
  147. following conditions.
  148. a. Attribution.
  149. 1. If You Share the Licensed Material (including in modified form),
  150. You must:
  151. A. retain the following if it is supplied by the Licensor with the
  152. Licensed Material:
  153. i. identification of the creator(s) of the Licensed Material and any
  154. others designated to receive attribution, in any reasonable manner
  155. requested by the Licensor (including by pseudonym if designated);
  156. ii. a copyright notice;
  157. iii. a notice that refers to this Public License;
  158. iv. a notice that refers to the disclaimer of warranties;
  159. v. a URI or hyperlink to the Licensed Material to the extent reasonably
  160. practicable;
  161. B. indicate if You modified the Licensed Material and retain an indication
  162. of any previous modifications; and
  163. C. indicate the Licensed Material is licensed under this Public License,
  164. and include the text of, or the URI or hyperlink to, this Public License.
  165. 2. You may satisfy the conditions in Section 3(a)(1) in any reasonable
  166. manner based on the medium, means, and context in which You Share the

  170. 3. If requested by the Licensor, You must remove any of the information

  175. Section 4 – Sui Generis Database Rights.
  176. Where the Licensed Rights include Sui Generis Database Rights that apply
  177. to Your use of the Licensed Material:
  178. a. for the avoidance of doubt, Section 2(a)(1) grants You the right to
  179. extract, reuse, reproduce, and Share all or a substantial portion of
  180. the contents of the database;
  181. b. if You include all or a substantial portion of the database contents
  182. in a database in which You have Sui Generis Database Rights, then the
  183. database in which You have Sui Generis Database Rights (but not its
  184. individual contents) is Adapted Material; and
  185. c. You must comply with the conditions in Section 3(a) if You Share
  186. all or a substantial portion of the contents of the database. For the
  187. avoidance of doubt, this Section 4 supplements and does not replace Your
  188. obligations under this Public License where the Licensed Rights include
  189. other Copyright and Similar Rights.
  190. Section 5 – Disclaimer of Warranties and Limitation of Liability.
  191. a. Unless otherwise separately undertaken by the Licensor, to the
  192. extent possible, the Licensor offers the Licensed Material as-is and
  193. as-available, and makes no representations or warranties of any kind
  194. concerning the Licensed Material, whether express, implied, statutory,
  195. or other. This includes, without limitation, warranties of title,
  196. merchantability, fitness for a particular purpose, non-infringement,
  197. absence of latent or other defects, accuracy, or the presence or absence
  198. of errors, whether or not known or discoverable. Where disclaimers of
  199. warranties are not allowed in full or in part, this disclaimer may not
  200. apply to You.
  201. b. To the extent possible, in no event will the Licensor be liable to
  202. You on any legal theory (including, without limitation, negligence) or
  203. otherwise for any direct, special, indirect, incidental, consequential,
  204. punitive, exemplary, or other losses, costs, expenses, or damages arising
  205. out of this Public License or use of the Licensed Material, even if
  206. the Licensor has been advised of the possibility of such losses, costs,
  207. expenses, or damages. Where a limitation of liability is not allowed in
  208. full or in part, this limitation may not apply to You.
  209. c. The disclaimer of warranties and limitation of liability provided
  210. above shall be interpreted in a manner that, to the extent possible, most
  211. closely approximates an absolute disclaimer and waiver of all liability.
  212. Section 6 – Term and Termination.
  213. a. This Public License applies for the term of the Copyright and
  214. Similar Rights licensed here. However, if You fail to comply with this
  215. Public License, then Your rights under this Public License terminate
  216. automatically.
  217. b. Where Your right to use the Licensed Material has terminated under
  218. Section 6(a), it reinstates:
  219. 1. automatically as of the date the violation is cured, provided it is
  220. cured within 30 days of Your discovery of the violation; or
  221. 2. upon express reinstatement by the Licensor.
  222. c. For the avoidance of doubt, this Section 6(b) does not affect any
  223. right the Licensor may have to seek remedies for Your violations of this
  224. Public License.
  225. d. For the avoidance of doubt, the Licensor may also offer the Licensed
  226. Material under separate terms or conditions or stop distributing the
  227. Licensed Material at any time; however, doing so will not terminate this
  228. Public License.
  229. e. Sections 1, 5, 6, 7, and 8 survive termination of this Public License.
  230. Section 7 – Other Terms and Conditions.
  231. a. The Licensor shall not be bound by any additional or different terms
  232. or conditions communicated by You unless expressly agreed.
  233. b. Any arrangements, understandings, or agreements regarding the Licensed
  234. Material not stated herein are separate from and independent of the
  235. terms and conditions of this Public License.
  236. Section 8 – Interpretation.
  237. a. For the avoidance of doubt, this Public License does not, and shall
  238. not be interpreted to, reduce, limit, restrict, or impose conditions
  239. on any use of the Licensed Material that could lawfully be made without
  240. permission under this Public License.
  241. b. To the extent possible, if any provision of this Public License is
  242. deemed unenforceable, it shall be automatically reformed to the minimum
  243. extent necessary to make it enforceable. If the provision cannot be
  244. reformed, it shall be severed from this Public License without affecting
  245. the enforceability of the remaining terms and conditions.
  246. c. No term or condition of this Public License will be waived and no
  247. failure to comply consented to unless expressly agreed to by the Licensor.
  248. d. Nothing in this Public License constitutes or may be interpreted
  249. as a limitation upon, or waiver of, any privileges and immunities that
  250. apply to the Licensor or You, including from the legal processes of any
  251. jurisdiction or authority.
  252. Creative Commons is not a party to its public licenses. Notwithstanding,
  253. Creative Commons may elect to apply one of its public licenses to
  254. material it publishes and in those instances will be considered the
  255. "Licensor." The text of the Creative Commons public licenses is dedicated
  256. to the public domain under the CC0 Public Domain Dedication. Except
  257. for the limited purpose of indicating that material is shared under a
  258. Creative Commons public license or as otherwise permitted by the Creative
  259. Commons policies published at creativecommons.org/policies, Creative
  260. Commons does not authorize the use of the trademark "Creative Commons"
  261. or any other trademark or logo of Creative Commons without its prior
  262. written consent including, without limitation, in connection with any
  263. unauthorized modifications to any of its public licenses or any other
  264. arrangements, understandings, or agreements concerning use of licensed
